ASTRA Sales Terms and Condition

The online store made available at  www.astrajewellery.com (ASTRA Online Store) is operated by ASTRA New Zealand Creation Limited. ASTRA believes strongly in protecting the privacy of its users and customers. By purchasing products from the ASTRA Online Store, you acknowledge that all personal information that you supply to ASTRA in connection with your purchase of a Product will be collected, used, disclosed and managed by ASTRA in accordance with its privacy policy. Your purchases of Products from the ASTRA Online Store will be governed by the following terms and conditions of Sale, including any other terms and conditions which may notified to you at the time of placing your order, for example, Gift with Purchase terms and conditions.  Please read these Sales Terms carefully before ordering any Products from the ASTRA Online Store. By ordering Products, you agree to be bound by these Sales Terms. In addition to the Sales Terms, by ordering any Products via the ASTRA Online Store you acknowledge and agree that your use of the website at www.astrajewellery.com will be governed by:

1. About these Sales Terms

Before placing an order on our website, you must read and agree the ASTRA sales terms and conditions. If you disagree the terms and condition, you must not place an order on the website.

These Sales Terms and Conditions apply to all orders for and purchases of products made from the ASTRA Online Store. ASTRA may revise these Sales Terms from time to time.  Any changes to these Sales Terms will be effective on the date on which they are posted on the ASTRA Online Store. 

2. Your account

If you create an account (personal user identification or username) on the ASTRA Online Store you are responsible for maintaining the confidentiality of your login information and restricting access to your password; all activities with your account information.

3. Prices, Shipping and Handling, Charges and Taxes

The price charged for a product will be the price in effect at the time your order is placed and will be set out in the Order Receipt Confirmation Email and in your Shipping Confirmation Email.  If you place additional or separate orders after receiving the Order Receipt Confirmation you will incur additional shipping and handling charges for such additional orders.

If there is a pricing error, whether on the ASTRA Online Store or in an Order Receipt Confirmation Email or otherwise, then to the extent permitted law ASTRA has the right to correct such error and charge the correct price or cancel the order.  If the actual price is more than the amount shown on your Order Receipt Confirmation Email ASTRA will contact you with the correct price before processing your order, and your sole remedy if such error occurs is to cancel your order.

4. Taxes

Currently ASTRA will cover all taxes and duties which may be applied by customs in New Zealand. If the delivery address is not in New Zealand. prices for the products do include any sales tax or other applicable taxes.

5. Shipping and handling cost

Separate charges for shipping, handling and their related GST or other taxes will be shown in your Order Receipt Confirmation Email and can be viewed on a summary screen prior to finalizing your order.

6. Promotional Codes

To redeem a promotional code, the code should be entered during check out when prompted. Promotional codes are valid for redemption on the ASTRA online store only. 

7. Placing an Order

To be able to buy ASTRA products on ASTRA online store you must:

  • read and accept these Sale Terms;
  • provide your name and address, delivery address, phone number, email address, payment details and other required information;
  • be aged 18 years or over, be legally capable of entering into binding contracts and the owner or authorized holder of a valid debit/credit card, if paying for the products with a debit/credit card.

You may place an order by clicking on the “ADD TO CART” button and proceeding to the checkout page.

You will be provided with an opportunity to review your order, read and accept the Sales Terms and Condition, check the total price of your order and the information you have provided, and correct any input errors before confirming your order.  ASTRA will not be responsible for any delay or failure to process your order if it is not completed properly or accurately. If you place any Products in your cart and accept our Terms and Conditions but do not complete your order, you agree that we may send you emails reminding you that you have an uncompleted order and prompting you to visit our online store to complete your purchase.

8. Order Processing and Contract Formation

Once you have submitted and confirmed your order using the ASTRA Online Store, ASTRA will send an order confirmation email to the email address you provided.

ASTRA may choose to reject all or part of an order in ASTRA’S sole discretion for any reason, including without limitation in the case of abnormal orders and orders which ASTRA suspects are not placed in good faith or for personal use, or orders in response to incorrect offers on the ASTRA Online Store made as a result of human, system or technology error (including errors in the image, description or price).If ASTRA rejects an order ASTRA will refund any money paid for that order.

After receiving your order, ASTRA will check that the ordered products are available.  A contract for the sale of the ordered Products between you and ASTRA on these Sales Terms will be formed when ASTRA emails you confirming the Shipment Confirmation Email).  The contract is formed on sending the Shipment Confirmation Email whether or not you receive such email.  You may save your Order Receipt Confirmation Email, Shipment Confirmation Email and these Sale Terms for your records.ASTRA will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Shipment Confirmation Email.

9. Delivery Locations

The ASTRA Online Store currently only ships to selected addresses and countries.  We regret if your address or countries are not included in our delivery locations. ASTRA is unable to deliver to certain addresses, including but not limited to, P.O. Box addresses, overseas army addresses, some hotels, hostels or prisons.

7. Payment

Payment must be made by one of the methods you have selected during the checkout process. The name on the credit card must be the same as the name of the person placing the order. If ASTRA does not receive the authorization that the payment has been processed ASTRA reserves the right to cancel your order. The value of your purchase will be settled from the applicable card when the order is placed.

If your credit card payment cannot be processed you will be notified of this on the ASTRA Online Store.  You will then need to contact the card issuer and endeavour to resolve the issue.

9. Events Outside ASTRA’s Control

ASTRA shall not be responsible for delay or failure to perform, if the delay or failure is caused by any act, event, non-happening, omission accident or circumstance beyond its reasonable control including but not limited to:

  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • strikes or lock-outs (or other industrial action);
  • national or local states of emergency;
  • failure of transportation facilities, power or utility outages, earthquake, fire, explosion, storm, flood, subsidence, epidemic or other natural disaster;
  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; or
  • the acts, decrees, legislation, regulations or restrictions of any government.
  • ASTRA’s performance is deemed to be suspended for the period that the above continues.

10. Product Information

If the Products you have received do not correspond to the ones you have ordered, or if your delivery is incomplete or damaged during transportation, please immediately contact ASTRA either by email or phone for assistance.

11. Title to Products

ASTRA retains full legal title to Products until it has received all amounts due on the ordered Products in full and you have received your Shipping Confirmation Email.  The Products will be at your risk from the time of delivery.

12. Return and Refund if You Change Your Mind

As a goodwill gesture, we have a 14 day return and refund policy for unused and undamaged products if you change your mind and return them, at your cost, within 14 days of delivery with a valid proof of purchase.  You must pay shipping costs to return goods.  If you wish to return the products you will need to contact ASTRA by email.

If you do not return the products within 14 days of delivery or do not have proof of purchase, ASTRA may refuse to give you a refund.  If you return any products in a used or damaged condition, ASTRA may refuse to give you a refund.

This return and refund policy is limited for customers not inside of New Zealand.

13. Jewellery Warranty Against Defects

ASTRA will at our option, repair or replace, jewellery proven by our jewellers to be defective due to the manufacturing process within 12 months after the date of purchase. ASTRA jewellery is 100% water proof with 12 months warranty after the date of purchase. This warranty against defects does not cover loss, damage, breakage, changes in appearance, kinks, or the gradual degradation of all or part of the goods due to: normal wear (including tarnishing); mishap; careless handling; improper use; the use of charms or items not manufactured by ASTRA; or use outside ASTRA’s care instructions.  Tarnishing occurs naturally and therefore, cleaning is not covered by this warranty against defects.

Proof of purchase: your order confirmation plus a credit card bank statement or tax invoice or other evidence of purchase which is satisfactory to us is required before we will process any warranty claim.

You will need to email us your proof of purchase, at your cost, to ASTRA online store.  If ASTRA is satisfied that the warranty claim is valid ASTRA will at its option arrange for either the repair or replacement of the jewellery.  ASTRA will advise you of your repair options (if any) and the retailer’s charges if your warranty claim is not accepted by ASTRA.

New Zealand Consumer Guarantees Act 1993

The ASTRA warranty against defects provides benefits in addition to the rights and remedies to which you are entitled under the Consumer Guarantees Act 1993 and does not exclude or limit those rights.

14. Privacy

By purchasing any products from ASTRA, you consent to ASTRA collecting, holding, using and disclosing your personal information in accordance with its Privacy Policy.

15. Transfer of rights and obligations

These Sales Terms are binding on you and ASTRA and on any person to whom ASTRA might transfer its rights. You must not transfer, assign, charge or otherwise deal with a contract with ASTRA, or any of your rights or obligations arising under it, without our prior written consent. ASTRA may transfer, assign, charge, sub-contract or otherwise deal with a contract with you, or any of ASTRA’s rights or obligations arising under it, at any time during its term.

16. Waiver

If ASTRA fails, at any time to insist upon strict performance of any of your obligations under these Sales Terms, or if ASTRA fails to exercise any of the rights or remedies to which it is entitled under these Sale Terms this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

17. Entire agreement

These Sales Terms, the Website Terms of Use, the Cookie Policy, your order as recorded in your Order Receipt Confirmation Email and confirmed in the Shipment Confirmation Email and any document expressly referred to in them represent the entire agreement between ASTRA and you and supersede any prior agreement, understanding or arrangement between the parties, whether oral or in writing.

You acknowledge that, in entering into a contract with ASTRA, you have not relied on any representation, undertaking or promise given by ASTRA or any third party or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these Sales Terms.

21. Governing law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of New Zealand.

Any dispute or claim arising out of or in connection with these Sales Terms or your purchase of Products from ASTRA (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of New Zealand.

22. Termination

Without prejudice to ASTRA’s termination or other rights under any other provision of these Sales Terms or applicable law, ASTRA may at any time prior to delivering the Products to you, immediately terminate the contract for the supply of Products to you if:
